| I am not a legal expert, let me just say that to start. But upon reading several pieces of information available, it almost seems like Pokerstars could resume business in the United States as soon as, well, now. In reading the Unlawful Gambling Enforcement act of 2006, the section stating... - Quote :
- UNLAWFUL INTERNET GAMBLING.— ''(A) IN GENERAL.—The term 'unlawful Internet gambling' means to place, receive, or otherwise knowingly transmit a bet or wager by any means which involves the use, at least in part, of the Internet where such bet or wager is unlawful under any applicable Federal or State law in the State or Tribal lands in which the bet or wager is initiated, received, or otherwise made.
...makes the bill only apply to where there is an existing state or federal law prohibiting the gambling. Prior to the release of a new position on the Federal Wire Act of 1961 by the Department of Justice, the Department of Justice has treated all forms of waging together. With the information in the article published by Forbes, the Department of Justice has changed its stance on the issue, and only wagering on sporting events and contests is now illegal under the act, paving the way for new inter-state lotteries and other online gaming. Was the United States government really after the "big three" poker sites? Probably. But Why? Was it to flatten the competition and create "opportunity" for a government supported poker site? After all, with Pokerstars out of the picture, most Americans are willing to try almost any site, since there is no equivalent in the current market. The state of Nevada was quick to pass new legislation allowing for the creation of online poker sites, and more are sure to follow. With all that being said, now that internet poker is no longer "illegal" or prohibited, and since the 2006 enforcment act should only apply where the wagers are illegal, who's to say Pokerstars couldn't resume operation in the USA immediately? I personally would like to see Pokerstars back, even if it meant paying some form of tax on any profits made. | |

| I think I read something that said it'd be a long time for US players to play on Pokerstars again (kinda like how PartyPoker is with Europe and ect) and only be open to foreign players. There'd be new poker rooms obv, but would be owned by Harrah's, Bellagio, ect (other poker casinos) | |
